OFFICIAL RULES
1. NO
PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS
OF WINNING. SUBJECT TO APPLICABLE FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED.
2. Eligibility.
Subject to the additional restrictions below, the Bisons Independence Eve Big
Ticket Giveaway (the "Giveaway") is open to legal U.S. residents of the following counties in the States of New York and
Pennsylvania: New York: Erie, Niagara, Orleans, Genesee, Wyoming,
Chautauqua, Cattaraugus, Allegany; Pennsylvania: McKean and Potter, who are 18 years or older at the time of entry. Employees and contractors of
Buffalo Bisons ("Sponsor"), WGRZ-TV ("Administrator"), Gannett Co., Inc., the
Buffalo Philharmonic Orchestra, KeyBank, and each of their respective
affiliated companies, and advertising and promotional agencies, and the
immediate family members of, and any persons domiciled with, any such employees
or contractors, are not eligible to enter or to win.
3. How
to Enter. The Giveaway will begin at 6:00 a.m. (E.T.) on
Tuesday, June 26, 2012 and end at 11:59 p.m. (ET) on Friday, June 29, 2012 ("Giveaway
Period").
On-line Entry. Enter by visiting http://www.wgrz.com/life/contests/bisons/ and completing all
of the required information and following all posted instructions. Complete the entry form and any other required fields and
then submit your vote for your Bisons fan favorite video posted on the entry
page, by clicking on the "SEND" button. Your computer must accept cookies, or
any successor or similar technology, which may be used for the purpose of entry
tracking. Ad blocking software on your computer needs to be disabled so that it
doesn’t interfere with processing your entry.
Only one (1) entry
per person, but you may vote as often as you like but only one (1) prize per household.
Submission of multiple entries or votes by means of software generated or other
automated processes will be disregarded. Multiple
entrants are not permitted to share the same email address. Entrants acknowledge
and agree that Sponsor and Administrator shall have the right to edit, adapt,
modify, reproduce, publish, promote, create a sound or video recording of,
broadcast, or otherwise display or use entries or posted videos in any way it
sees fit without limitation or compensation to entrants or the individuals
featured in the posted videos.
All
entries and votes must be received by 11:59 p.m. (E.T.) on Friday, June 29,
2012.
4. Winner
Selection. Eight (8) Bisons fan videos of individuals who previously
won Bisons tickets will be displayed on the entry page. Each entrant will vote
on their favorite video as part of their entry and will automatically be
entered in a random drawing for the First Prize. On or about Saturday, June 30,
2012, the First Prize Winner will be selected in a random drawing from all
eligible entries received. The video receiving the most eligible votes as of
11:59 p.m. (E.T.) on Friday, June 29, 2012 will be designated as the Grand
Prize Winner and the person featured in the winning video will receive the
Grand Prize. In the event of a tie, Administrator
will select the Grand Prize Winner from among the tied entries in a random
drawing. The decision of the Sponsor and Administrator is final.
5. Prizes
and Odds.
First Prize: The First Prize
Winner will receive two (2) tickets to the Triple A All-Star Game at 7:00 p.m.
(E.T.) on Wednesday, July 11, 2012 at Coca-Cola Field in Buffalo, New York
(ARV: $50 per pair). First Prize does not include transportation, lodging,
food, beverages, gratuities, taxes and any other expenses. Odds of winning the
First Prize depend on the number of eligible entries received
Grand Prize: The Grand Prize
Winner will receive a Buffalo Bisons Prize Pack consisting of miscellaneous
Buffalo Bisons apparel (ARV: 200) and two (2) tickets to the Triple A All-Star
Game at 7:00 p.m. (E.T.) on Wednesday, July 11, 2012 at Coca-Cola Field in
Buffalo, New York ($50 per pair) (ARV of entire Prize Pack: $250). Grand Prize
does not include transportation, lodging, food, beverages, gratuities, taxes
and any other expenses. Odds of winning the Grand Prize depend on the number of
eligible votes received.
6. Winner
Notification and Acceptance.
Each winner will be
notified by Sponsor or Administrator on or about Monday, July 2, 2012 at the phone
number or email address provided on winner’s entry. Sponsor or Administrator
will call during regular business hours and will leave no messages. If notified
by email, each winner must respond to Sponsor’s or
Administrator’s email notification within 48 hours. Failure to respond within
such time period or return of email prize notification as undeliverable may
result in disqualification and an alternate winner may be selected. To
claim the prizes, each winner must personally contact Administrator’s offices
at 259 Delaware Avenue Buffalo NY 14202 within five (5) business days after
notification (office visits must be between the hours of 9:00 a.m. (E.T.) and 5:00
p.m. (E.T.) weekdays) and must present a valid photo identification. Winners
may waive their right to receive prizes. Prizes are not assignable and
nontransferable. No substitutions allowed by winner. Prizes are not
redeemable for cash. Prizes and individual components of prize packages are
subject to availability and Sponsor reserves the right to substitute prizes of
equal or greater value. Winners are solely responsible for reporting and
payment of any taxes on prizes. Winners may be required to complete an
affidavit of eligibility/liability and a liability and publicity release
(except where prohibited by law) which must be returned as directed by
Sponsor. Failure to sign and return the affidavit or release, or to comply
with any term or condition of these Official Rules, may result in a winner’s
disqualification, the forfeiture of his or her interest in the prize, and the
award of the prize to a substitute winner. Except where prohibited, acceptance
of any prize constitutes each winner’s consent to the publication of his or her
name, biographical information and likeness in any media for any commercial or
promotional purpose, without limitation the Internet, or further compensation.
Prizes not won and claimed by eligible winners in accordance with these
Official Rules will not be awarded and will remain the property of Sponsor.
7. Participation.
By participating, entrants agree to be bound by these Official Rules and the
decisions of Sponsor. Sponsor or Administrator reserves the right to
disqualify persons found tampering with or otherwise abusing any aspect of this
Giveaway as solely determined by Sponsor. In the event the Giveaway is
compromised by tampering or other causes beyond the reasonable control
of Sponsor or Administrator which corrupts or impairs the administration,
security, fairness or proper operation of the Giveaway, Sponsor reserves the
right in its sole discretion to suspend, modify or terminate the Giveaway. Should
the Giveaway be terminated prior to the stated expiration date, Sponsor
reserves the right to award prizes based on the entries and votes received
before the termination date. Neither Sponsor nor Administrator will be
responsible for incomplete, lost, late, misdirected or illegible entries or
votes or for failure to receive entries or votes or other electronic
communications due to transmission failures or technical failures of any kind,
including, without limitation, malfunctioning of any network, hardware or software,
whether originating with sender or Sponsor. In the event of a dispute, all
online entries will be deemed to have been submitted by the owner of the ISP
account from which they were sent. For these purposes, an ISP account holder
shall mean the natural person assigned to such ISP account by the Internet
access provider, online service provider or other organization responsible for
assigning ISP addresses for the domain associated with such ISP account. Any
questions regarding the number of entries, or votes submitted or the owner of
an ISP account shall be determined by Sponsor or Administrator in its sole
discretion, and Sponsor or Administrator reserves the right to disqualify any
entries or votes by persons determined to be tampering with or abusing any
aspect of the Giveaway.
8. Copyright. By participating
in the Giveaway, each entrant grants to Sponsor and Administrator an exclusive,
royalty-free and irrevocable right and license to publish, print, edit or
otherwise use the video of the entrant, in whole or in part, for any purpose
and in any manner or media (including, without limitation, the Internet)
throughout the world in perpetuity, and to license others to do so, all without
limitation or further compensation.
9. Construction.
The invalidity or unenforceability of any provision of these rules shall not
affect the validity or enforceability of any other provision. In the event
that any such provision is determined to be invalid or otherwise unenforceable,
these rules shall be construed in accordance with their terms as if the invalid
or unenforceable provision was not contained therein.
10. Sponsor. The Bisons Independence Eve Big Ticket Giveaway us sponsored by Bison
Baseball Inc. The decisions of Sponsor and Administrator regarding the
selection of winners and all other aspects of the Giveaway shall be final and
binding in all respects. Sponsor and Administrator will not be responsible for
typographical, printing or other inadvertent errors in these Official Rules or
in other materials relating to the Giveaway. For a list of winners (available
